In this image the left leg is a bit behind the rail. In the page the rail is gone so you can see the rest of the foot.
Also the hat bill is definitly different though.

That is definately the same picture.

They just threw a line in to look like a hat for good measure. XD

Also, this pic makes a good candidate for a logo like that because the silhouette makes him easier to cut out in photoshop/ any other editing program.
